Lawsuit Filed in Arkansas Roll Over Accident That Left Man Paraplegic

Boone County, AR (OPENPRESS) January 24, 2009 -- An Everton, Arkansas man has filed suit against General Motors Corporation and Davis-Barr Chevrolet Pontiac, Inc. in the Circuit Court of Boone County, Arkansas because of a roll over accident that left him paraplegic.

On or about March 7, 2008, Campbell was driving his 2005 Chevrolet Colorado southbound on U.S. Highway 65 outside of Bellefonte, Arkansas when the vehicle overturned.

The vehicle's seat and restraint failed to perform as designed, resulting in catastrophic spinal injuries.

The suit says General Motors Corporation departed from the standard of care and duty owed to the plaintiff by carelessly and negligently failing to exercise reasonable care in the design, development, assembly, construction, manufacturing, testing, quality assurance, inspecting, promotion, advertising, marketing, selling, instructing and providing warnings for the 2005 Chevrolet Colorado.

General Motors Corporation also failed to properly test the vehicle's seats/seating systems' performance in crashes, including roll over accidents.

Davis-Barr Chevrolet Pontiac, Inc. also carelessly and negligently failed to exercise care in marketing and sale of the 2005 Chevrolet Colorado.

The defective nature of the product was a proximate and producing cause of Campbell's injuries.

The vehicle in question was defective and unreasonably dangerous because the seats/seating systems do not maintain their integrity and provide vital occupant protection and injury protection in foreseeable crashes, including roll over accidents.

"Lack of effective vehicle testing continues to be a primary fault in these types of cases," said attorney Rob Ammons.

"Injury would have been preventable through good design, but now a life is regrettably forever changed. It is the goal of this suit to help and somehow prevent future incidents like this from happening."
