Laguna Niguel, California (OPENPRESS) May 7, 2012 - A California consumer protection lawyer has filed a lawsuit against a popular Orange County, California Mercedes-Benz dealership alleging a failure to properly disclose potential penalty charges in Mercedes-Benz lease contracts. The lawsuit Kaghazchi v. Mission Imports, et al. was filed in California's Orange County Superior Court on April 18, 2012 (Orange County Superior Court Case No. 30-2012-00564149). The defendant, Mission Imports, operates the well known Orange County, California Mercedes-Benz dealership "Mercedes-Benz of Laguna Niguel." The plaintiff, Mehran Kaghazchi, is an Irvine, California consumer who is being represented by well known Orange County lemon law lawyer Michael R. Vachon, Esq.
ORANGE COUNTY LEMON LAW LAWYER'S COMPLAINT ALLEGES MERCEDES-BENZ OF LAGUNA NIGUEL MUST RESCIND CONSUMER'S LEASE CONTRACT BECAUSE OF FAILURE TO PROPERLY DISCLOSE POTENTIAL PENALTIES
In the lawsuit, the plaintiff's Orange County lemon law lawyer has alleged that Mercedes-Benz of Laguna Niguel violated the California Vehicle Leasing Act by failing to properly disclose that a consumer could potentially be charged $10,000 if he or she takes their leased vehicle outside of North America. More specifically, the lawsuit asserts that all such charges must be expressly set forth within the four corners of the automobile lease contracts signed by consumers. Mr. Kaghazchi's lemon law attorney alleges that Mercedes-Benz of Laguna Niguel didn't include this potential charge in the lease contract itself, but instead in a separate document entitled "Acknowledgment of Anti-Export Policy."
Mr. Kaghazchi's California lemon lawyer is further arguing that this alleged violation of California's Vehicle Leasing Act permits Mr. Kaghazchi to rescind the lease contract for his Mercedes vehicle and get his money back.
Please note: the court has not yet determined whether or not the allegations made by Mr. Kaghazchi's lemon law lawyer are true or whether Mercedes-Benz of Laguna Niguel violated the law. Mercedes-Benz of Laguna Niguel is expected to deny all wrongdoing and liability when it files and answer to the complaint.
ORANGE COUNTY LEMON LAW ATTORNEY HAS ANNOUNCED THAT HE IS ATTEMPTING TO LOCATE OTHER MERCEDES-BENZ OF LAGUNA NIGUEL CUSTOMERS
Mr. Kaghazchi's Orange County lemon law lawyer Michael R. Vachon, Esq. has stated that he is attempting to locate and contact other Mercedes-Benz of Laguna Niguel lease customers. He maintains that because the Kaghazchi v. Mercedes-Benz of Laguna Niguel lawsuit contains allegations that Mercedes-Benz of Laguna Niguel has a consistent business practice of failing to properly disclose lease charges, that other customers of the Laguna Niguel, California Mercedes-Benz dealership might be able to provide valuable evidence. He has requested that Mercedes-Benz of Laguna Niguel lease customers ccontact him at (855) 4-LEMON-LAW (1-855-463-6665).
